Tiffany Learns, Yet Again, That eBay Is Not Responsible For Users Selling Counterfeit Items

Back in 2004, famed jeweler Tiffany sued eBay, because some users on eBay were selling counterfeit Tiffany items. It's the same old story of secondary liability — with eBay pointing out (quite accurately) that if users are selling counterfeit goods, that's between Tiffany and those users. eBay is just the platform. But Tiffany didn't care. Its CEO even admitted that it was suing eBay because that was easier than going after those actually responsible. It's an incredible sense of entitlement by Tiffany: because it doesn't want to actually police counterfeit sellers, eBay should just step up and do so automatically?

The district court smacked down Tiffany on every count, explaining pretty clearly that it makes no sense at all for eBay to be responsible for the actions of users. And, of course, Tiffany appealed.

The appeals court has sided with eBay yet again, telling Tiffany, once again, that eBay is not liable for the actions of its users (full decision — pdf). The court notes that eBay seems to have bent over backwards — beyond what the law requires — to help Tiffany stop the sale of counterfeit items and to warn users to make sure they're buying legitimate items. It notes that while eBay may have had “general knowledge” of counterfeit goods on the site, whenever it had specific knowledge, it was quick to take down the offending content, and thus there was no secondary or contributory trademark infringement.

Separately, the court agreed with the lower court that eBay did not violate Tiffany's trademarks by mentioning Tiffany in its own ads — saying that it was entirely accurate to note that you could buy Tiffany products on eBay. That was factual, and thus, no trademark infringement. It made quick work of Tiffany's “dilution” claim as well, pointing out that eBay has nothing to do with that:


Tiffany argues that counterfeiting dilutes the value of its product. Perhaps. But insofar as eBay did not itself sell the goods at issue, it did not itself engage in dilution.

The one area where the appeals court differed from the district court is outside of the trademark realm, but on the question of whether or not eBay's ads that mention Tiffany could, potentially, be seen as “false advertising.” The court noted that there was nothing that was directly false in the ads (it was, again, accurate that you could buy Tiffany goods via eBay), but that it could be possible that users were mislead or confused. So it sent the case back to the lower court to retry that particular issue.

In the meantime, though, Tiffany wants to appeal the rest of the ruling to the Supreme Court, which may now have a chance to establish, clearly, that you can't pin secondary liability on a service provider. Tiffany's response to the ruling actually seems a hell of a lot more “misleading” than any of eBay's ads:


“EBay knew that counterfeit merchandise was being sold on its site — and EBay took no effective steps to stop it,” Tiffany Chief Executive Officer Michael J. Kowalski said in a statement. “EBay deliberately misled consumers for profit, and unfortunately the court has justified its actions.”

But that's simply, factually, incorrect. As the court clearly noted, eBay bends over backwards to try to stop counterfeit merchandise from being sold on the site. Hopefully Tiffany execs come to their senses, but it seems likely they'll still appeal, and still fail to recognize the difference between blaming the party doing the actual infringement and the service provider they use.

eBay said today it is launching a new microsite eBay Fashion that will sell clothing, shoes and accessories.

eBay Fashion offers a more visual shopping experience that highlights the selection of new, vintage, branded and designer merchandise available on eBay.

Users can click on a "Fashion Tab" in the top navigation on the eBay homepage. Users can shop by brand, category, similar items or trends. eBay has added new image search technology that allows users to choose an item and a "More Like This" feature displays other items that are similar in color, shape, and pattern.

"eBay Fashion delivers a visually rich and easy-to-navigate shopping experience for savvy style seekers and bargain hunters alike, making it simple to browse and buy from the world's largest online selection of new, used and vintage clothing, shoes and accessories," said Lorrie Norrington, president of eBay Marketplaces.

"So whether you want to shop for leading fashion brands, or buy from a trusted eBay seller with an eye for vintage clothes and the perfect accessories, eBay Fashion is a one-stop destination for style and value."

eBay Fashion will also offer a new feature that provides more access to new, fixed price, brand name clothing, shoes and accessories. The recently launched eBay Fashion Vault offers users "Buy It Now" access to new, direct-from-brand merchandise at discounts for a limited time while inventory lasts.

Grace almost got scammed on eBay. A fraudster cracked a high-value seller's account and posted a fake listing for a camera and tried to make Grace pay for it using Western Union, a huge warning sign of a scam. That's typical, but these criminals went the extra mile. “Above and beyond,” if you will. When she tried to ask some questions about the transaction, they directed her to a live online chat that was mocked up to look like a real eBay customer service chat and tried to assuage her concerns by telling her it was okay to use Western Union because she had “buyer protection!” Here's her story and the chat transcript so you can learn and not get burned:

This is an eBay deal I won't be doing. But it is pretty amazing how far they went to try to convince me it would be a real transaction, fake online chat staff and all. I read Consumerist often so I figured it out in time, but…wow.

Here's how it went down:

1. The item, a camera lens, was listed under a verified seller's eBay account. The seller had more than 2300 positive reviews, a dozen active listings and a storefront. There were about 10 pictures of that particular used lens and an in-depth description of its condition. There was a great return policy. I read a few pages of feedback and visited a link to their used electronics brick-and-mortar store in New Jersey. Feedback was excellent and I felt solid about the seller.
2. The seller asked in the item description that questions to be directed to a specific gmail account rather than eBay because they couldn't access eBay at work or something like that. It seemed a little weird but not unheard of, and I figured, hey, they have such great feedback… How can 2300 other people be wrong?
3. I emailed a question about the item, they (“Craig”, the name of the seller as listed on eBay) wrote back within a few minutes and said it was mine for the Buy It Now price if I wanted it, and they asked for an address to calculate shipping costs. Still, there was no “Buy It Now” link on the auction, and I asked for them to post it officially on the auction itself to complete the transaction through the regular channels.
4. They didn't respond to my request for a “Buy it Now” link on the auction. Instead, I get this email (below), confirming the sale through eBay, which asks for payment via Western Union. Warning bells went off (thanks, Consumerist!) and I wrote back that I would do the sale only with Paypal and I asked for their Paypal information. No response to that, even though I heard back within about 2 minutes the last time. I was hoping somehow the listing was real even as evidence mounted that it wasn't. I guess there's no place for optimism when it comes to eBay.
5. An email comes from eBay saying the listing is pulled because the seller's account had been compromised by someone else, which confirms my suspicions. The seller WAS legit, so I was right about that. But the listing wasn't theirs.
6. I did a live chat linked from the email below, which is the kicker, and is copied below. You can probably chat with them via the same link if you want.The chat spoofs eBay's page and is a secure site.

I knew there were sketchy sellers with sketchy eBay sites, but I thought those could be spotted by the lack of feedback, bad English, no return policies, etc. I hadn't really considered encountering one fake auction mixed in with a dozen real auctions under an actual legitimate seller's account. I also didn't think scammers had internet chat staff waiting online, but hey, what do I know.

You: The email said that I received it because someone else had accessed the seller's account and NOT to proceed with the sale. It says right on eBay: “Pay safely online by never using instant cash transfer services such as Western Union or MoneyGram International to pay for your eBay purchases. These payment methods are unsafe when paying someone you do not know. Learn more.”
Sarah B.: Yes, dismiss that message. Never use instant cash transfer services such as Western Union or MoneyGram International to pay for your eBay purchases when you don't get the buyer protection.
Sarah B.: This is a private transaction on eBay that's why we accept the payment by Western Union.
You: Can you send me a link to the Buyer Protection? I only found on Ebay that it helps you talk to the seller but can't find anywhere that it says eBay will refund you the money from their account.
Sarah B.: I am here to confirm you that this is a valid transaction and you are 100% covered doing it this way. So you should feel safe. Next step, you should send the payment to the seller so he can ship your package.

This interaction betrayed several classic eBay scam warning signs:

1. Directs user to use contact outside eBay system
2. Asks you to pay outside of eBay using Western Union
3. Bad grammar
4. Biggest tell: everyone knows it's impossible to get a human at the real eBay.

Nowadays, eBay is becoming a fast increasing market for online shoppers. It gives them the convenience and feasibility of shopping online.

However, it is the seller that benefits most of the time as they find selling things on eBay a lucrative way of earning additional wages. But before a seller logs in and sell his or her items on eBay, there are some things that needs to be done first, here’s how:

1. Sellers must know the rules.

It is extremely important for sellers to know first the rules and regulations of eBay concerning items to be sold and the transaction method. This is one way of protecting themselves so as to avoid fraudulent activities.

2. They should know their market.

Before selling, a seller should first contemplate on what type of market is she or he aiming at. If the sellers know who their target market is, it would be easier for them to think of effective words to use on their descriptive title and the details of their items.

3. They should know the selling fees.

It’s a must for them to know how much the selling fees of eBay are so that they may include this on the initial price of their item.

5. They should know how to make an account.

It is, indeed, important for the seller to know first the basic procedures of creating an account on eBay before selling an item. No one can go start selling an item right away without having an account on eBay.

They should know how to register first. They can do this by going to the eBay website and set up a seller’s account by entering some pertinent information like a valid credit/debit card account or bank account. Though, they may opt for an alternative if they are not comfortable doing this. They may opt to become ID verified as a substitute.

For payment purposes, they should also know how to open a PayPal account.

Also, they should know first what kind of format to use, the category of the item, how to write the title and the specifications of the sale, item description, how to increase the item’s visibility, and how to contact the winning bidder before starting to post an item on eBay.

If all of these things are already clear on the seller, then posting an item on eBay will never be a problem. It’s that easy!

    From my experience of selling on Ebay, you have to accept that there will be good times and bad – profit and loss and as long as you are sensible you can do well. As Frank says though, it's a definite learning curve, Christopher.

    Being a chocoholic in Vancouver isn’t very hard. Places like Chocolate Arts, Cocoa Nymph and Thomas Haas cater to us chocolate addicts in plenty of ways. Similarly, the city has much to offer to coffee lovers, with some top quality coffee shops to be found.

    For me, the ultimate treat is something that combines coffee and chocolate: the Mocha. Given the combination of great chocolate and coffee shops, one would think that finding a good Mocha would be easy as well. Perhaps not…

    Most Mochas are made with a chocolate syrup (or in some cases, hot cocoa powder) that is mixed in with a latte. Unfortunately, this results in a less than stellar, overly sweet and not very well balanced drink. The telltale syrup residue in the bottom of your cup will remind you of that. I was more or less resigned to this rather sad state of affairs until the day I walked into the Mink Chocolate Cafe. I had just moved offices to the PricewaterhouseCoopers building on the downtown waterfront and was exploring the neighbourhood in search of lunch spots. Mink was an instant hit with its great selection of house made chocolate bars and other treats. What I didn’t know was that Mink crafts its Mochas in a completely different way. They have warm molten chocolate(dark and milk) used for their various treats that they mix in with milk, then steam to form a frothy, creamy and altogether delicious hot chocolate. They then mix that in with freshly brewed Espresso from a Synesso machine to create what I still think is the best Mocha in the city. It strikes the perfect balance between foamy milk, creamy chocolate and Espresso. Mink quickly became my favourite spot for quick coffee breaks, 1-1 meetings and general afternoon treats.

    Since discovering Mink, I have come across a few other places around the city that craft a Mocha worthy of Mink’s lofty bar. I have since changed jobs and am still downtown but too far away from the waterfront for a quick Mink stop. Now thoroughly addicted to high quality chocolate and coffee concoctions, I had no choice but to scour the city again for a good Mocha.

    I was in luck, Medina Cafe, the sibling of Chambar, one of Vancouver’s most popular restaurants, makes a mean Mocha. They use the same chocolate sauce they put on their delectable waffles as a base for their Mochas and the result is very tasty. Given the fact that they also produce great food, Medina has quickly become my #1 lunch spot, it is only 3 blocks from my office.

    There are others, Uva Wine Bar in the Moda hotel serves lunch during the day and makes the most uncompromising Mocha I know, they make it with only three ingredients. Michel Cluizel dark chocolate chips, organic milk and freshly brewed Espresso from 49th Parallel beans. When I first went there, the barista offered to add some simple syrup to sweeten the drink. I declined, wanting to try it straight up and oh boy, what a kick of strong coffee with a great note of dark chocolate! I drop by Uva every few days now for one of these hefty brews.

    Chocoatl in Yaletown, the tiny chocolate shop next to the Mini dealer on Mainland, was one of my favourite spots, run by a passionate chocolatier who took great pride in his work. Sadly, the business went down and was replaced by Eataly, a small Panini and coffee spot. Themis, the original owner of Chocoatl is behind the counter and given his passion and talent for chocolate, serves up some very tasty treats (his brownies are delicious) and brews a great Mocha. He also starts with chocolate chips, melted by the hot steamed milk and mixed in with the Espresso. I am in luck again with Eataly being easy walking distance from my office. I now have three regular spots where I can get my fix and they all brew a very good Mocha.

    There are a couple of others worth mentioning. 49th Parallel, the acclaimed coffee shop in Kitsilano follows the same principles, using molten chocolate mixed in with their perfect Espresso to make a very good Mocha. Then there is Thomas Haas of course, I can be found there on Saturday afternoons for lunch, enjoying his chocolate creations while enjoying a Mocha.

    I do a fair bit of traveling and whenever I am abroad I look for recommended coffee shops to find Mochas. The results have been surprisingly dismal, there is some very good coffee to be found in US cities like Seattle and San Francisco, but they are still firmly in the chocolate syrup stage when it comes to Mochas. Europeans usually have no idea what a Mocha is, which led to some very interesting exchanges in Swedish coffee shops while I was in Stockholm for work. This is where I count myself fortunate to be in Vancouver, where a Mocha can be a small work of art…

    Oregon's unemployment rate has improved since the soldiers left for their final pre-deployment training, but it's still quite high. The rate was at 10.1 percent in February, according to the Oregon Employment Department.
    “We're going to be pushing in every nook and cranny of our state to find employers who are willing to hire vets and I think we can do it,” said Sen. Ron Wyden (D-Oregon).
    A new website, FortOregon.com, is being created to help soldiers find jobs and services.
    Worksource Lane, the Lane County's employment office, already gets federal funding for three veteran's services officers who work to find returning and current vets find jobs.

    The above is from Laura Rillos' “Home from Iraq — and looking for work” (KVAL — link has text and video) which is the latest attempt by the media to draw attention to the problems facing returning service members, especially those serving in the National Guard. The whole country is facing an unemployment crisis and a recession. For members of the Guard, returning home can be a lot like being laid off or fired in terms of money coming in. The Congress could address this and Wyden has proposed adding 90-days of pay for Guard members so they return with a cushion but whether or not the Congress will get behind such an idea remains to be seen — thus far, it appears no. Possibly most indicative via Rorye O'Connor's article for the Mt. Vernon Register-News on Senator Dick Durbin visiting an outpatient center in Mt. Vernon where he apparently made no mention of the economy or the way it weighs on those returning from deployments. Maybe the answer will be governors? Lance Renaud (KFJB via Radio Iowa) reports on two bills Iowa Governor Chet Culver has signed:

    The first bill stipulates that veterans with service-connected injuries who qualify for unemployment or who receive benefits from the Veterans Trust Fund do not have to pay taxes on those benefits. The second bill directs the Iowa Department of Human Services to coordinate with the Mental Health Planning Advisory Council to ensure that a “knowledgeable” veteran serves on the council.

    The Governor's Office issued the following press release on the bills Tuesday:

    MARSHALLTOWN — Governor Chet Culver today signed two pieces of veterans’ legislation at the Iowa Veterans Home in Marshalltown. House File 2532 allows benefits from the Veterans Trust Fund to be exempted from individual income tax, and Senate File 2175 provides for veteran representation on mental health policy bodies.

    “As Commander-in-Chief of the Iowa National Guard, I am proud of the men and women who have served our nation in war and in peace, abroad and at home,” Governor Culver said. “Their commitment and courage is unrivaled and must always be honored. I am proud to work for those who have served, returned to their homes and families and, in some cases, need our support. My hope is that this legislation will provide the support and appreciation they all deserve.”

    Below are summaries of the legislation the Governor signed:

    House File 2532
    Allows the two benefits of the Veterans Trust Fund – travel expenses related to follow-up medical care and unemployment assistance – that provide direct payments to the veteran to be exempted from individual income tax. The bill applies retroactively to January 1, 2010, for tax years beginning on or after that date.

    Senate File 2175
    Directs the Department of Human Services to coordinate with the Mental Health Planning Advisory Council so that a military veteran who is knowledgeable about behavioral and mental health issues of veterans is on the council. The council is required by federal law as a condition of receiving federal mental health funds. DHS does not make this appointment but can work with the council to identify and appoint a veteran. Also adds a member, appointed by the Governor, who is a military veteran knowledgeable about behavioral and mental health issues to the Mental Health, Mental Retardation, Developmental Disabilities, and Brain Injury Commission.

    John Larson (Tacoma Weekly) notes the problems experienced by a Guard member returning from deployment and a service member leaving the military:

    Chris MacDonald served in Kuwait for a year in the Army National Guard. When he returned to his home in Vancouver in 2008, the only work he could find was as a security guard. He quit and was on unemployment for a while. He has found the skills he learned in the military are hard to transfer into civilian work. MacDonald is pursuing work as a pipe fitter now.
    Deidre Connor of Bonney Lake left the Army after nine years in 2005. She got an offer to clean kennels for minimum wage. “That is not what I want to do,” Connor said. “It is not putting my skills to use.”

    Peter Hirschfeld (Vermont Press Bureau via Rutland Herald) reports on the “66 members of Vermont's Air Ambulance Unit” who will deploy to Iraq in September and are scheduled to serve there until September 2011 and notes that this will be the unit's second deployment to Iraq. Meanwhile Dusty King is serving in Iraq and, Kris Betts (KTEN News, link has text and video)reports, fourth graders in Sherman, Texas are sending his platoon coffee which they would not otherwise have. The teacher of the fourth graders is Gerri King, Dusty's mother, who says, “They feel forgotten over there. He said tell them thank you. It's such a wonderful thing to have someone remember us and send us coffee.”

      As a beverage, qishr (or kishr) and its variations are prepared from the husks of coffee. Qishr is the Arabic word for skin. On Ethopia’s Omo River, the beverage was called buno, presumably derived from bunna, the Amharic word for coffee. (None of these languages use the Roman alphabet, and phonetic transliterations always vary in spelling.) Though I’ve learned about the beverage during several trips to Ethiopia, because of my friend, Abdullah, I’ve saved this piece for Ramadan, the Muslim month of fasting, which began the weekend of August 22nd.

      When I mentioned this drink to Abdullah, a Yemeni who grew up in Addis Ababa, he recalled it fondly. His mother served dates and qishr each evening during Ramadan to break the day’s fast. There is nothing religious about qishr, sometimes called qishr buna; it’s one family’s way to break the fast. His mother’s qishr was flavored with ginger and cardamom.

      A brief review: coffee cherries contain seeds wrapped in “parchment.” First, the flesh of the fruit is separated, leaving the seeds, later to become coffee beans, in parchment. The seeds are dried and remain in parchment until they’re prepared for shipping. At this point, the beans are milled, separating the husks from the beans, which are then sorted and bagged for shipping.

      When neighbors gather for buno, news of the tribe from this village and others is shared. Government visits, conflicts with other tribes, and harvest or planting news are all reported.

      In most places, the husks are used for compost or burned as fuel to power the coffee processing operation. In Yemen and Ethiopia, parchment is sold to make qishr. In Ethiopia, the equivalent of 12 cents would buy about a quart volume of husks. This beverage may be available in other coffee-growing areas, but I’ve only encountered it in these countries.

      Like coffee itself, various levels of care and consumer preference produce different taste experiences. When fermented fruit from the coffee cherries is left mixed into the husks, the taste changes considerably. In my cups, the fruit seemed to have been culled before brewing.

      Although I’d heard of this beverage, I didn’t actually get a cup until I visited the lower Omo River. I accompanied my photographer wife, Jane, on one of her many visits among the tribes who still live traditionally along the river. On a few occasions we were invited to someone’s ono (the Kara house made of sticks, roofed with long grasses) for buno. As is often the case with coffee (e.g. the Ethiopian coffee ceremony in the Highlands has its own elaborate protocols), the Kara rituals surrounding this simple beverage greatly enrich the experience.

      Our camp was adjacent to the Kara village of Duss, and we were privileged to be invited to morning “coffee” with Ari and Karsche. The structure of this pre-dawn occasion was remarkable. The embers of the evening’s fire are kept burning through the night. When Karsche arises, she revives the fire. The pot of water is put on the fire, and the husks are added to the boiling water.

      Morning coffee occurs before dawn. No food is taken in the morning; this is breakfast. As invited guests arrive, they are seated according to gender and position or age. The man of the house always sits by the door, with a respected elder across from him. The other men sit to his left arranged by seniority, and the women sit on the opposite side, with the woman of the house by the fire.

      The man of the house is served first, followed by important guests, the other men according to their seniority, and then the women. The buno is ladled from the pot into individual half-calabash gourds. Members of the household have specific ones reserved, just as we have our special mugs.

      When all have been served, everyone waits for the host to begin. He blows across the surface, and he calls barjo (pronounced bario), the Kara (and Hamar) life force, as best I understand it. Barjo is everywhere. People have barjo, as do natural elements like clouds. Prospective bridegrooms are interviewed to evaluate their barjo. A person with the best barjo would be most harmoniously integrated into the society.

      When there are no guests, the family still observes this ritual each morning.

      When the man of the house is absent, as was the case on another occasion, his calabash is still served first. Later, after we had begun drinking, our hostess ladled from his calabash to hers, then added hot buno to each calabash. Serving the man’s buno in his absence is to acknowledge his spirit in the ono.

      When neighbors gather for buno, news of the tribe from this village and others is shared. Government visits, conflicts with other tribes, harvest or planting news are all reported. When someone is speaking before he has brushed his teeth, he is thought to always tell the truth. Although government schools are now in most Ethiopian villages, the oral tradition is maintained at home. All Kara social gatherings at home start with buno. We observed a gathering of men discussing conflict with another tribe across the river. Buno came first. When Jane was invited to a female, mid-morning “coffee,” buno started the conversation.

      Although the Kara drink also directly from the river, the water for buno is always clarified. After a very short time of stirring the water with a block of Kulup wood attached to a stick, the turbidity precipitates, and the water becomes clear.

      I’m sure there are variations in strength, but each time I drank it, buno smelled and tasted like a very weak black tea, with a slight tang of tannin. There were no additives, and there wasn’t much flavor, certainly no coffee flavor, though the husks probably contain some caffeine. Other parts of the plant, including the leaves, have caffeine.

      My buno (qishr) was really an innocuous drink, quite different from the sometimes sweetened and spiced version. While I can’t recommend it over a cup of roasted coffee, I strongly suggest you take any invitation to enjoy the social gathering surrounding a cup of buno. But you’ll probably need a cup of coffee soon after.

    Jetzt war es mal wieder soweit ! Ein cooles Hundebetten muß her!!! Ich bin es Leid, das mein Hund immer meinen Stammplatz auf dem Sofa besetzt. Was sind unsere Kaufkriterin für ein Hundekissen, damit unser Hund es auch gut hat? Dafür sollte es groß genug sein, damit er ganz draufpasst und abwaschbar, falls er mal sabbert.
    Also ging es  los unser Streifzug auf der Suche nach dem richtigen Hundekissen.

    Wir fanden auch ein geniales, leider war der Laden am anderen Ende der Stadt
    und so haben wir beschlossen, eins im Web zu bstellen.
    (Danke der Beratung im Laden wußten wir ja was wir wollten, wir hätten auch sehr gerne dort gekauft, aber wenn die nicht liefern … selbst Schuld)
